  1. BOOKINGS & CONFIRMATION
  1. Bookings will be definite on acceptance of Terms and Conditions
  2. South Coast Mile Builders (SCMB) will confirm the booking, via email or in writing.
  3. SMCB Cancellation policy is as follows:
  1. Booked dates are final.  It is not possible to change dates once you have booked.
  2. You may cancel your course at any time, written notification must be received, and will be effective on the day notification is received.
  3. A 25% Min booking deposit is required at time of booking if booking is made over 28 days from the start of the course.  If a booking is made within 28 days of the start of the course, full payment is required.
  4. The balance of payment is to be made no later than 28 days prior to the date of the course.
  5. If payment has not been received 28 days prior to course date, the student will be contacted by our sales team.  If payment has not been received after contact, SCMB reserve the right to sell the berth.  The student will forfeit the deposit.
  6. Any student who fails to arrive for the course, for whatever reason, will automatically forfeit 100% of the course fees.
  7. Cancellation charges are as follows:

Period Before Departure:

57 days and above.  No cancellation charge. Payment will be returned minus a 3% handling charge for card payments or the bank charges incurred for an online bank transfer.

29 – 57 days, before course date.  25% Deposit is charged

0-28 days before course date.  100% of course fee is charged

  • SCMB reserve the right to cancel a course due to adverse sailing conditions.  In this situation, a full refund of monies already paid or rebooking on alternative course will be offered to students. If a rebooking is made, the new booking is subject to the new course Terms and Conditions.

SCMB will not be liable for loss of expenses incurred by the client due to the cancellation and advise clients to take out insurance to cover such an incidence.

  • For safety purposes, all sailing trips require minimum numbers to run, SCMB reserve the right to cancel a trip due to insufficient numbers according to conditions.  In this situation, a full refund of monies already paid or rebooking on alternative course will be offered to students. If a rebooking is made, the new booking is subject to the new course Terms and Conditions.

SCMB will not be liable for loss of expenses incurred by the client due to the cancellation and advise students to take out insurance to cover such an incidence.

  • SCMB reserve the right to make alterations to the course including (but not limited to) a change of departure point, a change of destination, a change of instructor, a change of vessel, for whatever reason.  These changes do not affect conditions of contract or are to be viewed as a cancellation.
  •  CLIENTS RESPONSIBILITIES & SKIPPERS DECISIONS
  1. Smoking & Vaping is not permitted while on board any vessel
    1. Clients must not be under the influence of alcohol or illegal drugs at any time.
    2. It is the Clients’ responsibility to ensure they are physically able to take part in the course.  Any pre-existing medical conditions must be declared at the time of booking. Details of any medication being taken must be recorded on the booking form and be discussed with the skipper when boarding.
    3. Clients must behave responsibly for the duration of the course and have consideration for others on the vessel.  Inappropriate behaviour towards another student, the instructor or people on other vessels could result in a student being excluded from the course. The Sailing Director and/or Skipper/instructor on board a vessel have final decision on the resolution of these matters. The Skipper shall take any action or decision he considers fit for the well being of the vessel and crew.
    4. In accordance with marine practice, the Skipper’s decisions are final always.  All crew/clients will abide by all orders and decisions given to them by the Skipper at all times whilst onboard the scmb vessel’s or ashore, for the duration of the course until the course is complete. The Skipper’s authority is total in accordance with Marine Law.  If for any reason whatsoever a client does not accept an order from the Skipper, whether the client considers it to be reasonable or not. The Skipper may take any action or decision he considers fit for the well being of the vessel and crew.
    5. If the client is placed ashore at the nearest port, no liability whatsoever shall attach itself to SCMB and neither shall the client have any claim for any expenses or unused portion of the fee. Neither any claim against the Skipper or SCMB as a result of actions taken by the Skipper. 
  • SAILING TRIP DURATION

a) a 1 day trip will start approximately 8am and finish approx. 6pm) Practical 2, 3 & 5 day courses, from approximately 0900 on the first day until 1600 hours on the last day or otherwise stated on your booking confirmation. Theory courses, from approximately 0900 on the first day until 1700 on the last day.
c) Note that these are only a guide and any variation will be made prior to the course commencing. 

  • LATE RETURN OF SAILING VESSEL 

For whatever reason beyond the date of the course the Students can stay onboard at the company’s victualling expense or return home if they wish at their own expense. No liability shall extend beyond this. 

5) UNDER 18’S 

a) 16 –18 year olds are accepted on a trip when sailing with a parent or guardian. For students under 18 these Terms and Conditions must be accepted by the parent or guardian. 

b) under 16’s are not accepted on a scheduled course.  However, specific courses can be arranged for Under 16’s, if accompanied by a parent or guardian.  Please contact SCMB directly to discuss.

6) INSTRUCTION ON YOUR OWN YACHT

a)   The Client will be expected to reimburse any travelling or out-of-pocket expenses for the Instructor from the Gosport base to wherever the vessel is lying, and the return journey plus salary on a pro-rata fee rate, if applicable.
b)   The client’s vessel will be expected to be equipped with the minimum RYA standards and provide the Instructor with all bedding, victualling whilst on board.
b)   If the Student’s vessel is over 50 miles from Gosport and it is not possible for the Instructor to get to the Student’s vessel within 2 hours, please allow pro-rata fees.
c)   Insurances: The Owner must notify his Insurance Company that there will be a qualified Instructor onboard delivering tuition but the Owner remains the Skipper at all times. It is also agreed that the Owners Insurance is Fully Comprehensive and covers all aspects of normal marine insurance for the area in which the Skipper is expected to sail, with additional days leeway to allow for adverse weather 

7) FOREIGN PORTS 

a)  Please take your passport on any course in the event of calling into any foreign country, whether intended or not.

b)  A Client can not bring anything on board the school vessel whilst in a foreign port, without permission from the Skipper.  The student must indemnify SCMB, its employees and staff, against any actions that may result from breach of this rule. 

8) SEA TIME 

Every attempt will be made to give clients maximum sea time. However, if in the Skipper’s opinion weather conditions, safety or any other consideration make this unwise, the Skipper’s decision is final. 

10. DUTIES ONBOARD:
a) All Clients will be expected to participate in cooking, cleaning vessel and routine maintenance as required by the skipper, At the end of the course all clients will be expected to clean the vessel.
b) clients who stay onboard for an exam are required to clean the boat once the examiner has left.

11. DISPUTE 

Any dispute should be brought to the attention of the skipper or Sailing Director at the earliest opportunity to be resolved.

12.  INSURANCE

a)  All vessels are insuredagainst accidents and third party liability.

b)  Responsibility is not accepted for personal accidents or damage or loss attributable to any clients negligence, recklessness or gross misconduct. SCMB reserves the right to hold any client liable for any or all damage or loss resulting from negligence or misconduct.

c)  SCMB strongly advises that the clients obtain their own insurance.

d)  By signing the Terms & Conditions, the client accepts SCMB Insurance Policy.  A copy of the insurance can be obtained by contacting SCMB.

13. DISCLAIMER
a) No liability is accepted for any client’s vehicles parked in the Marina grounds, or client’s Possessions in the vehicle, on the pontoons or in the companies  vessels or accommodation.
b) No liability is accepted for clients whilst on company grounds, in any of the company properties, on ladders, pontoons or vessels and all clients participate in any aspect of any course at their own risk. 

14. DATA PROTECTION

a)  SCMB will not pass or sell on any of your personal details to any third party with the exception of the Royal Yachting Association for the purposes of certification registration only. b) By making a booking with SCMB you will be added to our mailing list to receive latest news and offers, you will have the opportunity to opt out if you wish via these mailings. SCMB will hold your personal details on a secure server in order to keep information regarding your past and future bookings.
